1. Tracellent Driver PDPA Statement on Malaysia Personal Data Protection Act 2010

This PDPA Statement describes how Tracellent Driver and its affiliates collect, retain, and handle personal information (as defined below) in accordance with the Personal Data Protection Act 2010 ("PDPA") and Malaysian law. Please review this PDPA Statement regarding the personal data we may collect from you. By providing us with your Personal Information, you consent to this PDPA Statement and our Privacy Policy, as well as the collection, use, access, transfer, storage, and processing of your personal information as outlined in this PDPA Statement and our Privacy Policy.

2. Information We Collect

Location Information: Tracellent Driver utilizes the GPS functionality of your mobile device to calculate the speed of the vehicle, track driving behavior, and monitor travel distances.

Device Information: We may collect information about your mobile device, including the device model, operating system version, unique device identifiers, and mobile network information.

In addition, we may receive, store, and process your personal data that is provided or made available by any third parties, credit reference bodies, regulatory and law enforcement authorities, for reasons such as delivery of our products and/or services, performance of the terms and conditions of our agreements, and/or compliance with our legal and regulatory obligations

3. How We Use Your Information

To Provide and Improve Our Services: We use the information collected to provide you with the services offered by Tracellent Driver, including calculating vehicle speed, analyzing driving behavior, and tracking travel distances. We also use this information to improve the performance and features of our app.

To Communicate with You:We may use your information to send you important updates, notifications, and other communications related to your use of the app.For Research and Analysis:We may use aggregated and anonymized data for research and analysis purposes to understand trends, improve our services, and develop new features.

4. Purpose of Acquiring Users’ Personal Information

Tracellent Driver processes your personal data only for specific and limited purposes. You agree that all personal data collected and/or processed by Tracellent Driver may include but not be limited to the following purposes:

a. For administrative and operational purposes;
b. For contact and communication purposes;
c. For internal records management;
d. For identification and verification purposes;
e. For compliance with laws and regulations;
f. To understand our audience and improve how our websites work;
g. To respond to your comments, questions, suggestions and/or requests;
h. To resolve and/or to attend to any concerns, complaints and/or issues received;
i. To inform you of our services;
j. To provide you with the information/support you requested;
k. To market and advertise our services to you.
l. To process applications for and the provision of Tracellent Driver Products and/or services;
m. For research, statistical studies and/or data analysis purposes;
n. To detect, investigate and prevent any fraudulent, prohibited or illegal activity or omission or misconduct;

p. For our storage, hosting back-up (whether for disaster recovery or otherwise) of your personal data, whether within or outside Malaysia;
q. For all other purposes incidental and associated with any of the above.

5. Background Location Usage

Tracellent Driver may require access to your device's location services while running in the background for certain functions to work effectively. These functions may include but are not limited to::

Continuous Monitoring:Tracellent Driver may need to continuously monitor your location in the background to provide accurate tracking of travel distances, calculate vehicle speed, and analyze driving behavior even when the app is not actively in use.

Report Calculation: Background location access may be necessary to calculate your driving behavior and based on the calculated score it will produce a driving behavior report on per trip.

Geofencing: Tracellent Driver may utilize geofencing technology that requires access to your device's location while running in the background to trigger actions based on your proximity to predefined geographic boundaries.

Please note that enabling background location services may impact your device's battery life. You can manage and control background location access through the app settings and your device's privacy settings.

Opting Out of Background Location Tracking
You have the option to disable background location access within the app settings or through your device's privacy settings. However, please be aware that certain features of Tracellent Driver may not function properly or may be limited without background location access.

5. Disclosure of your personal information

We will not use or disclose your Personal Information except in accordance with this PDPA Statement and as permitted or required by any enactment, law, statute, or regulation, and only with your prior consent (implied and/or express).

6. The right of users

Notwithstanding anything to the contrary, you may withdraw your consent to Tracellent Driver processing your personal data or any part or portion thereof at any time by sending a written notice of withdrawal to Tracellent Driver at the address listed below and within the period prescribed by the PDPA. Tracellent Driver shall take all steps necessary to implement your withdrawal of assent, provided that doing so does not conflict with any of Tracellent Driver's other legal obligations.

If you do not wish for your personal information to be shared with other parties, or if you do not wish to be solicited for services offered by Tracellent Driver or any other parties, including third parties, please notify us in writing using the contact information provided below. You shall have access to all personal data held, stored, or processed by Tracellent Driver upon written request. To avoid confusion, "access" for the purposes of this provision shall mean notification of such personal data of yours that is processed by or on behalf of CSM and to have a copy of such personal data communicated or conveyed to you in an intelligible form chosen by Tracellent Driver.

7. Acceptance of Policy

You are hereby notified that access to our services is contingent upon your acceptance and agreement to the terms specified in this Notice. This express acceptance and assent will be indicated by clicking, checking, or otherwise indicating your agreement on the designated consent section of the registration forms or any other documents provided, as applicable.

You are deemed to have granted unequivocal consent for the processing of your personal data by Tracellent Driver or any duly authorised agents, employees, partners, and/or contractors associated with Tracellent Driver by indicating acceptance of the terms in this Notice. This processing shall be conducted for the specific purposes outlined below.

By registering for our services or continuing to use them, you consent to the processing of your personal data by Tracellent Driver and, when necessary, the disclosure of your personal data to the categories of third parties specified by Tracellent Driver. This processing and disclosure is necessary for Tracellent Driver to provide you with the requested services. Your explicit assent to the processing of any sensitive personal data pertinent to the aforementioned purposes is hereby acknowledged.

Please note that we reserve the right to amend, update, or otherwise alter this Personal Data Protection Policy at any time. We will take reasonable measures to notify you in advance of such modifications. Modifications will be communicated via platform announcements or other appropriate channels. In the event that such changes are made, your continued engagement with us, use of our services, purchase of our products, or access to our platform will be construed as your acceptance of the revised terms.

8. Security of personal Data

We are committed to storing your personal information securely. To prevent unauthorised access, disclosure, and other similar risks, we implement, to the extent possible, appropriate technical, physical, electronic, and procedural security measures in accordance with applicable laws, regulations, and industry standards to safeguard against and prevent the unauthorised or unlawful processing of your personal data, and the destruction of, or accidental loss, damage to, alteration of, or access to, such data.

We would like to inform you, however, that due to the nature of the Internet, the above-mentioned data protection rules and security measures may not be observed by individuals or institutions beyond our control. Even data sent via email that is not encrypted can be read by third parties. We have no technical means to prevent this. The user is responsible for preventing unauthorised access to the information he or she provides, notably user names and passwords, through encryption or other means. We cannot and do not accept accountability for any unauthorised access, interception, or loss of personally identifiable information that is beyond our control.
